I am planning to buy house and lot in Cebu Philippines ,.... What are important things need to do that it would be legally for me after I pay it?,.. I hope that you haven't committed to buying anything yet, because if you're asking these questions, that means you haven't done your homework yet and need to do more research. First of all, you have to be a citizen to own real property here; foreigners are allowed to own only condominium units. Assuming you are qualified to own land, you also have to make sure that the certificate of title is genuine, and that the person selling is authorized to sell it. Third, you have to be sure that the real estate taxes on the property are up to date; otherwise, you are in danger of paying huge amounts in tax arrears, or buying property that has already been forfeited to the government for non-payment of taxes. Especially, be careful of certificates of title where the owners indicated are already deceased, as this could mean a legal scuffle with the heirs of the deceased owner if some of them are excluded. This could also mean that the estate taxes are unpaid, so research, research, research.





As to documents, you must, of course, prepare a deed of sale, and you or the seller or both must pay the taxes on the transfer: capital gains tax, documentary stamp tax, etc.. Proof of payment of all taxes due are required to be presented to the Bureau of Internal Revenue, so that you can be issued a certificate authorizing registration of the property in your name. The register of deeds will not transfer the title to your name without this certificate.

In answer to your query, it seems that, indeed, the land is co-owned by several people, which could be why the seller says she has no title in her name and that you will get your title when the property is sub-divided. What she is actually selling you is her interest in the [undivided] co-ownership. As co-owner, she has no right to sell any particular portion of the land without the consent of her co-owners if the property has not been partitioned yet. I suggest that you not pay her until you get these facts straight. Please make sure that the co-owners have no objection to her selling you that particular portion.
